Terms & Conditions

By accessing or using the FairwayDesk platform ("Service"), operated by FairwayDesk ("we", "us", "our"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

FairwayDesk is an AI-powered communications and operations platform for golf clubs. The Service includes member management, conversation handling, tee time management, campaign tools, knowledge base, review management, and integrations with third-party services.

To use the Service, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms.

Each club on FairwayDesk has one or more administrators who can invite team members and assign roles. Administrators are responsible for managing access to their club's data and ensuring team members comply with these Terms.

Available roles are Admin (full access including team management) and Viewer (read-only access to club data).

You agree not to:

• Use the Service for any unlawful purpose
• Send spam, unsolicited messages, or misleading communications through the platform
• Attempt to gain unauthorised access to the Service or other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or any harmful content
• Use the AI features to generate harmful, misleading, or inappropriate content
• Scrape, crawl, or otherwise extract data from the Service without permission

You retain ownership of all data you upload or create on the platform ("Your Data"). By using the Service, you grant us a limited licence to process Your Data solely to provide and improve the Service.

You are responsible for ensuring you have the right to upload and process any personal data of your club members, visitors, and contacts in accordance with applicable data protection laws (including UK GDPR).

The Service uses artificial intelligence to generate responses on behalf of your club. While we strive for accuracy, AI-generated content may occasionally be incorrect or inappropriate. You acknowledge that:

• AI responses are generated based on your club's knowledge base and configuration
• You are ultimately responsible for communications sent from your club, including AI-generated ones
• You should review and monitor AI-generated content and disable AI handling if responses are unsatisfactory
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content

The Service integrates with third-party platforms including WhatsApp (via Twilio), Gmail, and Outlook. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or functionality of third-party services.

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications that temporarily affect access. We will endeavour to provide advance notice of planned downtime.

Pricing and billing terms will be communicated separately. We reserve the right to change pricing with reasonable notice. If applicable, failure to pay may result in suspension of service.

To the maximum extent permitted by law, FairwayDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold FairwayDesk harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

You may delete your account at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Club administrators may delete their club, which permanently removes all associated data.

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
